Join us for an overview of several noteworthy benefits-related court rulings from 2023. The presentation will highlight select legal developments and the lessons they offer employers, employee benefit plan sponsors, and plan service providers. We’ll look not only at the legal decisions, but at some background facts as we consider together whether and how litigation might have been avoided. Topics will include recent U.S. Supreme Court, Courts of Appeal, and District Court opinions relating to:
• 401(k) excessive fee litigation
• Executive compensation case law developments
• Severance benefit plans and the need for careful plan drafting
• Long-term disability appeals
• Key pending key benefits and employment law rulings that demand
Kelly S. Kuglitsch

Kelly Kuglitsch is an attorney with O’Neil Cannon firm, and practices exclusively ERISA, Benefits and Compensation law. She regularly assists employers, plan administrators, plan service providers, and other attorneys with a variety of transactional and compliance-related employee benefits issues. Working collaboratively with the Employment, Corporate and Litigation Practice Groups at her firm, she also oversees transition matters relevant to mergers and acquisitions and serves as a subject-matter expert.
She has spoken on the topic of executive compensation for both the State Bar of Wisconsin Taxation Section and the ABA Taxation Section S-Corporation Subcommittee. Her article, “Spotting Issues Under Section 409A: Perspective and Practice Tips, appeared, in 2018, in Corporate Taxation, Vol. 45, No. 1, a Thomson Reuters publication. Kelly is a former officer of the Taxation Section of the State Bar of Wisconsin.
Kelly earned her J.D. from the DePaul University College of Law, and her M.A. from The George Washington University.
